- You must provide true, complete, and current information (name, email, WhatsApp number, address) and keep it up to date. False information may lead to suspension or closure of the Account.
- We may refuse a registration, request additional identity verification (e.g. national ID or business registration), or restrict the Services where there are signs of abuse, fraud, or security risk.
3. Account Security
- You are fully responsible for keeping your password, OTP codes, API tokens, VPN/WireGuard configuration keys, and every other credential provided through the Services confidential.
- Use a strong, unique password. Do not share your Account or credentials with unauthorised parties.
- All activity carried out with your Account or credentials is deemed to be your action, unless you have reported suspected misuse beforehand.
- Notify us immediately at [email protected] if you know or suspect unauthorised access, credential leakage, or any other security incident.
- We may require additional security measures such as email/WhatsApp verification, OTP, IP restrictions, or a password change to protect your Account and our systems.
4. Acceptable Use Policy
You must not use the Services, directly or through others, to:
- Carry out any activity that violates the laws of the Republic of Indonesia, including the Electronic Information and Transactions Law (UU ITE) as amended and its implementing regulations, or the laws of any country where your traffic is processed.
- Distribute or facilitate online gambling, pornography, child exploitation, terrorism, hate speech, hoaxes, or any other content prohibited by law.
- Commit fraud, phishing, carding, money laundering, sale of personal data, or social engineering.
- Send spam, bulk email/WhatsApp messages without the recipients' consent, or messages that violate platform provider policies (e.g. Meta/WhatsApp).
- Spread malware, ransomware, botnets, command-and-control (C2) infrastructure, cryptojacking, or other malicious code.
- Perform DDoS attacks, port scanning, brute force attacks, vulnerability exploitation, or penetration testing against systems you do not own without the owner's written permission, including against S-Network infrastructure.
- Run open proxies, open relays, or anonymisation services used to hide offenders from law enforcement.
- Infringe the intellectual property rights of others, including distributing pirated software or content.
- Disrupt, overload, or attempt unauthorised access to any part of the Services, servers, networks, or other users' data.
- Resell the Services without our written consent.
Violations may lead to IP/port blocking, suspension, or immediate termination of the Services without refund, and to
reports to law enforcement. You are responsible for all User Content and all traffic passing through your Services,
including traffic generated by your own customers or end users.
5. Personal Data Protection (Privacy Policy)
- Data we collect: identity and contact data (name, email, WhatsApp number, address), account data (hashed password, language/time zone preferences), transaction and billing data, technical data (IP address, user agent, login times, session history, access and security logs), and Service configuration data.
- Purposes: providing and managing the Services, account verification, billing, technical support, sending service notifications and announcements, preventing fraud and abuse, keeping our systems secure, and complying with legal obligations.
- Legal bases: your consent, performance of a contract (these Terms), compliance with legal obligations, and legitimate interests in system security, as provided by the PDP Law.
- Third parties: to operate the Services, certain data may be processed by our partners such as payment providers, cloud and data centre providers, domain registrars, DNS/CDN providers, email providers, WhatsApp providers, and threat intelligence services. Some partners may process data outside Indonesia; we ensure an equal or higher level of protection as required by the PDP Law.
- We do not sell your Personal Data to anyone.
- Retention: Personal Data is kept while your Account is active and for as long as needed for the purposes above or as required by law (e.g. accounting and tax). Technical and security logs are kept for a limited period based on security needs and legal obligations, then deleted or anonymised.
- Your rights as a Data Subject: to be informed, to access and obtain a copy, to rectify, update, and erase, to restrict or suspend processing, to withdraw consent, and to object to the processing of your Personal Data. Send requests to [email protected]; we will respond within the time limits set by the PDP Law. Withdrawing consent may mean some Services can no longer be provided.
- Data breaches: if a personal data protection failure occurs, we will notify you and the relevant authority within 3 x 24 hours as required by the PDP Law.
- Data inside your Services: for User Content containing other people's personal data (e.g. WhatsApp contacts, email mailboxes, or your customers' data), you act as the Data Controller and must have a valid legal basis; S-Network acts as a Data Processor and processes it according to your instructions given through the Services.
6. Information Security
- We apply information security controls based on best practices and international frameworks such as ISO/IEC 27001, including role-based access control, additional authentication for administrators, encryption of stored credentials and secrets, encrypted connections (HTTPS/TLS), activity logging and monitoring, intrusion detection, data backups, and incident and vulnerability management.
- No system is entirely risk-free. You remain responsible for securing your own devices, operating systems, routers, servers, applications, and data, including keeping your own backups of important data.
- To keep the Services secure and detect abuse, we may monitor traffic metadata and logs (e.g. IP addresses, ports, connection times, and traffic volume). We do not read the contents of your communications unless required by law, requested by you for technical support, or necessary to handle a security incident.
- Security vulnerabilities in our Services can be reported responsibly to [email protected]. Do not exploit or publish a vulnerability before we have fixed it.
7. Legal Obligations and Cooperation with Authorities
As an Electronic System Operator we comply with applicable laws, including UU ITE, Government Regulation No. 71 of 2019
on the Operation of Electronic Systems and Transactions, and related ministerial regulations. We may retain logs and
disclose Account information, Personal Data, or technical logs to law enforcement or competent authorities upon a lawful
request, and must act on orders to block access to prohibited content.
8. Payment, Service Period, and Refunds
- The Services are prepaid at the price and for the period shown when ordering. Prices may change and apply to subsequent orders or renewals.
- A Service becomes active once payment is confirmed. You are responsible for renewing the Service before it expires.
- Services that are not renewed may be deactivated and, after a grace period, their configuration and data may be permanently deleted without recovery. IP addresses, ports, or other resources may be reassigned to other users.
- Payments are non-refundable, except where we fail to activate a Service due to our own fault, or where required by law.
- Third-party fees (e.g. domain registration and SSL certificates) follow the third party's policies and are generally non-refundable.
9. Service Availability
- We make reasonable efforts to keep the Services available, but they are provided "as is" and "as available" without any guarantee of uninterrupted operation, unless otherwise stated in a written service level agreement (SLA).
- Scheduled or emergency maintenance may cause temporary interruptions. Where possible, maintenance information will be published as an announcement in the dashboard.
- Speed, latency, and availability are also affected by third-party networks (your ISP, carriers, upstream providers) beyond our control.
10. Suspension and Termination
- We may suspend or terminate your Account or Services, with or without prior notice, if you breach these Terms, have unpaid invoices, are subject to a valid abuse report, where required by law or an order of a competent authority, or to prevent harm or security risk to us or others.
- You may stop using the Services at any time and request closure of your Account through our support contact.
- Provisions which by their nature survive termination (including responsibility, indemnity, limitation of liability, and governing law) remain binding.
11. Limitation of Liability
- To the extent permitted by law, S-Network, PT. Koneksi Virtual Nusantara, and their directors, employees, and partners are not liable for any indirect, incidental, special, or consequential losses, including loss of profit, revenue, data, or reputation, arising from the use of or inability to use the Services.
- Our total liability for any claim relating to the Services is limited to the fees you paid for the relevant Service in the 3 (three) months before the event giving rise to the claim.
- We are not responsible for User Content, the actions of your end users, or losses caused by your failure to protect your credentials.
- Nothing in this section limits any consumer rights that cannot be excluded under Law No. 8 of 1999 on Consumer Protection.
12. Indemnity
You agree to indemnify and hold harmless S-Network and PT. Koneksi Virtual Nusantara and their affiliates, directors, and employees
from all claims, lawsuits, fines, losses, and costs (including reasonable legal fees) arising from your breach of these
Terms or applicable law, your User Content, or the use of the Services by you or your end users.
13. Force Majeure
We are not liable for delays or failures to perform caused by circumstances beyond our reasonable control, including
natural disasters, fire, power outages, third-party network failures, large-scale cyber attacks, civil unrest, pandemics,
or government actions or policies.
14. Intellectual Property
The S-Network dashboard, software, scripts, trademarks, logos, and documentation belong to us or our licensors. You
receive a limited, non-exclusive, non-transferable right to use them solely to make use of the Services. You retain all
rights to your User Content.
15. Communications and Changes to These Terms
- You agree to receive notices about the Services, billing, security, and announcements by email, WhatsApp, or in the dashboard.
- We may update these Terms from time to time. Material changes will be announced in the dashboard or by email, and you may be asked to read and accept the Terms again before continuing to use the Services. If you do not agree with the changes, you may stop using the Services.
16. Governing Law and Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia.
- Any dispute will first be settled amicably through deliberation within 30 (thirty) days after either party gives written notice.
- If deliberation fails, the dispute will be settled by the competent District Court in the Republic of Indonesia, without prejudice to a consumer's right to pursue consumer dispute resolution under applicable law.
17. Miscellaneous
- If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
- Our failure to enforce a right does not waive that right.
- You may not assign your rights and obligations under these Terms without our written consent.
- These Terms are made in Indonesian and English. In case of any difference in interpretation, the Indonesian version prevails.
